At VEF & Partners, We recognised early on that the emerging phenomenon of cryptocurrencies would have important economic - and therefore legal - implications for society, even beyond national borders. For this reason, we have created a specific department within the firm, made up of professionals highly specialised in civil and tax matters, who are experts in the analysis and evaluation of this particular type of asset, its circulation and the heterogeneous regulations that have affected it and which (to tell the truth) are still not free of inconsistencies, criticisms and gaps. We have done this with the aim of, firstly, bringing these assets back into the system, secondly, identifying their precise and correct regulation and, finally, on the basis of these objectives, enabling them to be regularised for their respective owners (natural or legal persons), with the main aim of bringing them back into full legality.
Through this process, we have developed strong skills in this very specific context, which allow us to assist our clients, both in the entry into legality and in the management of cryptocurrencies, as well as in the initiation and supervision of intermediation activities in a coveted, but at the same time potentially insidious sector. This has led us, together with the Agenzia delle Entrate, to carry out the first legalisation of cryptocurrency assets in Italy and to conclude agreements with leading professional firms in order to pave the way for financial intermediaries to approach this panorama in the short term. In this context, we assist cryptocurrency holders and issuers, exchange platforms and custodian service providers in the application of their respective tax and fiscal regulations, as well as financial intermediation and anti-money laundering regulations.
